Frequently asked questions · Folio 06

What clients ask holding the record.

I received a fine, what do I do first?+

Do not pay or reply on autopilot. Pin down the date you were notified, because deadlines run from there, and send us the full resolution. We reply with the route, the deadline and the fee in writing.

What should I do during an inspection visit?+

Ask for the order and the inspectors’ IDs, allow the visit without obstructing it, and mind what gets written in the record: you can state your disagreement right there. Ideally you have a protocol before it happens; we leave one in place for you.

Can PROFECO sanction my business?+

Yes, over matters such as advertising, pricing, adhesion contracts or consumer complaints. Proceedings have stages and defenses; the key is responding on time and with evidence.

Appeal, annulment trial or amparo?+

It depends on the act, the authority and your goal: speed, suspension or precedent. We lay out the routes with their risks and costs, and you decide. The administrative appeal is optional; sometimes going straight to trial is better.

Can a closure be challenged?+

There are routes to challenge it and to request suspension while it is resolved. The analysis of the record and the order defines the strategy; moving fast matters.

How much does a defense cost?+

A fixed fee in writing after reviewing the resolution or the record. For the day to day, the on-call lawyer from $15,000 MXN per month plus VAT.

Did a government act arrive?

Send us the document and we reply with the route, the running deadline and the fee in writing, within 24 hours.
