REPSE questions, answered briefly.

What is REPSE?+

It is Mexico’s Registry of Providers of Specialized Services or Specialized Works, run by the Ministry of Labor (STPS). Individuals or companies that provide specialized services or works by placing their own workers at a client’s disposal must register, as long as those services are not part of the client’s corporate purpose or main economic activity.

Does my company need to register with REPSE?+

If you place your own personnel at a client’s disposal for a specialized service, yes. If you only sell products or provide services without placing personnel with third parties, in principle no, although it is worth reviewing case by case: the test depends on the contract and on how the service actually operates, not only on your line of business.

What happens if I hire a vendor without REPSE?+

Payments for those services are not deductible for income tax and the VAT is not creditable, and you can be jointly liable for social security obligations of the vendor’s workers. In addition, the fine under article 1004-C of the Federal Labor Law applies both to the party providing and to the party benefiting from improper subcontracting.

How large are the REPSE fines?+

The fine for prohibited subcontracting of personnel, or for providing specialized services without registration, ranges from 2,000 to 50,000 UMA under article 1004-C of the Federal Labor Law. At the 2026 UMA of $117.31 per day, that is a range of $234,620 to $5,865,500 MXN. The same penalty applies to whoever benefits from improper subcontracting.

How often is the REPSE registration renewed?+

Every three years, counted from inscription in the registry. Renewal is filed within the three months before expiry, and the STPS recommends starting 90 days in advance. If you registered in 2023, your renewal window falls in 2026.

What are ICSOE and SISUB, and when are they filed?+

They are the periodic reports for REPSE holders: ICSOE before IMSS and SISUB before INFONAVIT. They are filed no later than the 17th of January, May and September, for the previous four month period; when the 17th falls on a non-working day, the deadline moves to the next business day. Failing to file the ICSOE on time carries a fine of 500 to 2,000 UMA.

What works better for a foreign company: REPSE or an EOR?+

An EOR (employer of record) is a third party that hires the personnel for you. In Mexico, subcontracting of personnel is prohibited as a general rule, so any scheme of this kind must operate within the specialized services framework and REPSE. It helps you start fast, but it usually costs more per person and limits your control over the team. If your Mexico operation is serious, incorporating your own entity and hiring directly is usually the healthier path; we help you compare both with numbers.
